My wife and I have a 2nd Mortgage with Countrywide. In October 2005, I got called back into full time Military Service again. I called and informed Countrywide what was happening. They had me Fax a copy of my orders to them, I also mailed a hard copy of my orders to them as well. By law Countrywide is suppose to reduce my interest rate to a minimum 6%. I went ahead and made October 2005 payment, the Soldiers and Sailors Relief Act(SSRA) Department representative ensured me that the over paid interest amount would be credited our account. November 05', December 05'came and went, each month we made our payments. Each month I called, I wrote and e-mail my concerns and complaints.

I received a letter from Countrywide claiming that our loan did not qualify for the SSRA. January 2006, February 06', March 06' came and went and the interest rate had not been changed. Finally in April 2006, Countrywide adjusted our account to reflect the 6% interest rate. But they did not go back and adjust all the previous months in question. May 2006, we pay our mortgage everything seems fine except still nothing had been done about the previous 5 months of payments. Now, we are talking about three hundred plus dollars per month. A interest rate of 12%variable to 6% fixed. June 2006, we pay our mortgage and our set payment changes again? July 2006, I am home on leave for my 43rd Birthday. As I am getting ready to go to bed after my wifes throwing me a surprise Birthday Party. I go into my Home Office and see that I have a message. I playback the message to hear some woman contacting me in regards to finding out what we were planning on doing with our home which was publically listed for foreclosure. After listening to the message again to make sure I was hearing what I thought I heard. I called my wife into my Office and played the message for her. Needless to say, we did not get much sleep that night. Being that that took place on a Friday night there wasn't much I could do until Monday, so that weekend was ceratinly ruined. Monday morning comes and sure enough Countrywide had listed our home in foreclosure.

To date,(9/28/06), Countrywide has not told us how or why this all came about. I think that I have figured it out how it happened. In October I made two mortgage payments,(OCT 3)and(OCT 24), they applied the October 24th payment to principle instead of processing as our November payment, even though our November statement receipt was included with the payment. They did this again in December. That was the beginning of things, what followed was the worst barrage of telephone calls and mailings from every foreclosure shark, we were getting things all the way from Hawaii and the East Coast. I had to take additional leave because I could not leave my wife and daughter in this mess. I have since returned, but the problem remains still not corrected. The Military won't do anything to aid me because its a Civil matter they claim yet Uncle Sam has my behind everyday for another year. I honestly just wanted them to correct the situation, I'm not a sue happy kind of person. But I think of the months of aggravation and the unecassary stress that this has put on my wife and I. I actually saved and counted all of mail that we received because of Countrywides mess. We received 1137 pieces of mail in regards to our "FORECLOSURE". I know enough about the law to know that when an account is in question or being contested that the company can not take any type of action until the complaint has been resolved. But, here, Countrywide had an account being contested, "its clearly in their notes", went ahead and filed our home in foreclosure. My latest contact with them was last week, I got this call and "all" the monies have been applied properly. Their records show that we are behind four months after "all" the credits have been made. So, we are suppose to send them like $1,400.00 and that will bring our account current for September. When I do the math they owe us money after bringing our account for September 2006.

With all this information that you have at hand I would ask to speak with the (OOP)Office of the President...Yes, they actually have one and they are very quick in resolving problems and correcting matters like these... When you contact Countrywide just make sure you ask to speak with the OOP...They have a direct line to the office and sometimes they will transfer the call.

Also, try using the website...Countrywide has a great website set up for their homeowners to view information...Possibly might be able to send an email to the OOP and get something resolved that way instead of calling Countrywide.

Richard,

Countrywide will never admitt that they are wrong. Our foreclosure is "in review" and the longer they take the farther we get behind, which means the more we are going to owe. Get a Lawyer! Maybe it's time for a class action suit??
